Agreement to Terms

By accessing or using FIX it!™, you agree to these Terms of Service. If you are using FIX it! on behalf of a school or district, you represent that you have authority to bind that organization to these terms. These terms apply to all teachers, administrators, and students using the platform.

Permitted Use

FIX it! is a grammar and language-arts instruction tool designed for classroom use. You may use the platform to deliver grammar lessons, mentor-sentence and anti-mentor practice, review games, and assessments, review student progress data, and access instructional resources. You may not reverse-engineer, resell, or redistribute the platform or its content.

Accounts & Access

Teacher and administrator accounts are created through a paid license or trial signup. Teachers are responsible for keeping their login credentials secure and for managing how their classes use the platform. Students do not have accounts on FIX it!; they join a session by entering a short code shared by their teacher and a teacher-assigned identifier (typically a first name or initials). No student email address, age, password, or other personally identifiable information is collected.

Cancellation

Schools and districts may cancel their license at any time. Unused portions of annual licenses are non-refundable. Monthly Teacher subscriptions may be cancelled at any time and will not renew after the current billing period.

Limitation of Liability

FIX it! is provided as-is. In Between the Lattes, LLC is not liable for indirect damages, data loss, or interruptions beyond our reasonable control. Our total liability is limited to the amount paid for the applicable license period.

What We Collect

For teachers and administrators, we collect name, email address, school or organization affiliation, and usage data necessary to deliver the service. For students, we collect only what is required to record PROVE strategy responses within a session: a teacher-assigned identifier (typically a first name or initials) and the responses the student submits inside the platform. We do not collect student email addresses, ages, grade levels, login credentials, biometric data, location data, or any other personally identifiable information directly from students.

How We Use It

  • To deliver and improve the FIX it! platform
  • To generate class-wide and individual student reports for teachers
  • To recommend instructional resources based on class performance data
  • To communicate with educators about their account or new features
We do not use student data for advertising, marketing, or profiling. We do not sell any user data to third parties under any circumstances.

Data Retention & Deletion

Assessment data is retained for the duration of the active license period plus 12 months to allow for year-over-year comparison. Upon written request, all data associated with a school or district can be permanently deleted within 30 days.

Third-Party Services

FIX it! relies on a small set of vetted, industry-standard service providers to operate the platform. Each is governed by its own terms and privacy commitments, and we limit the data shared with each provider to the minimum necessary to deliver the service. Payment processing never receives student data, and student responses used to generate coaching feedback are processed without student identifiers attached and are never used to train AI models.

We do not share student assessment data with payment processors, advertisers, analytics platforms, or any third party outside the operational providers needed to run the service.

Your Rights

Teachers and administrators may request access to, correction of, or deletion of their personal data at any time. Schools retain full control over student records and may request export or deletion on behalf of their students.

FIX it! uses only the cookies required for the platform to function. We do not use advertising cookies, tracking pixels, or third-party analytics that build behavioral profiles of users.

Essential Cookies

  • Session cookie: keeps you logged in during your session
  • Preference cookie: remembers teacher mode and class settings
  • Security token: protects form submissions from unauthorized access

What We Don’t Use

  • Advertising or retargeting cookies
  • Social media tracking pixels
  • Cross-site behavioral tracking
  • Fingerprinting technologies
Because we use only essential cookies, no opt-out banner is required under most jurisdictions. You will not be prompted to accept or decline cookies when using FIX it!.

You can clear cookies at any time through your browser settings. Disabling essential cookies will prevent login and session functionality from working correctly.

Our Commitment

FIX it! is designed to support a school or district’s obligations under the Family Educational Rights and Privacy Act (FERPA). When a school engages FIX it! to deliver assessments to its students, we act as a service provider performing a function that the school would otherwise perform itself. We use any student information solely to provide that contracted educational service, and we do not redisclose student information to other parties without the school’s authorization.

Schools and districts that require a signed Data Privacy Agreement (DPA) or designation as a “school official” under their local interpretation of FERPA may contact us to put one in place before launch.

What This Means in Practice

  • Students do not have accounts on FIX it! and we never ask them to create one
  • Students join a teacher-launched session using a short code; the only student-side identifier is one assigned by the teacher (typically a first name or initials)
  • We do not collect student email addresses, ages, grade levels, passwords, biometric data, or location data
  • Student assessment records are accessible only to authorized teachers and administrators within the school’s account
  • We do not share student records with any third party for purposes other than operating the platform
  • No advertising is shown to students and no advertising network has access to the platform
  • Student data is never used to build advertising profiles, sold, or licensed for commercial purposes outside the educational service
  • Student data is never used to train AI models

Data Access & Deletion Rights

Schools retain control over the assessment records associated with their classes. Upon written request from an authorized school or district contact, we will provide a copy of the records associated with that account or permanently delete them within 30 days. Because we do not collect personally identifiable information from students directly, parental and eligible-student (18+) rights under FERPA are exercised through the student’s school in the ordinary course.

COPPA: Students Under 13

The Children’s Online Privacy Protection Act (COPPA) places limits on the collection of personal information from children under 13. Because FIX it! does not collect personal information from students directly (no student creates an account, provides an email address, or supplies any identifying information beyond what their teacher has already assigned), the platform is designed to operate within the “school authorization” framework recognized by the FTC, where the school provides consent on behalf of parents for educational use.

FIX it! never asks a student to enter their own name, email, age, grade, or any other personal information. Every student-facing session is anonymous from the platform’s perspective; teachers assign and recognize student identifiers within their own classes.

State Privacy Laws & District Agreements

We support school districts that need to comply with state-level student data privacy laws, including Texas SB 820, and we are willing to enter into a written Data Privacy Agreement with a district before launch. Districts with specific contract or documentation requirements should reach out to us directly so we can work through them together.

Brand Marks

FIX it!™, The Grammar That Talks Back™, the Sentence Bad Guys™, the Everything’s a Remix™ framework, In Between the Lattes™, and all associated logos, product names, and visual identity are trademarks claimed by In Between the Lattes, LLC. One or more of these marks are the subject of trademark applications with the United States Patent and Trademark Office; the ™ symbol indicates an unregistered claim of rights in commerce. We will update this page to reflect the ® symbol for any mark that subsequently registers.

Use of these marks (in promotional materials, articles, social media, derivative products, training materials, or in any context that suggests endorsement by or affiliation with In Between the Lattes, LLC) requires written permission.

The FIX it! Instructional Frameworks

FIX it!’s instructional methodology, including the Sentence Bad Guys™ anti-mentor system for naming and fixing fragments, comma splices, run-ons, and awkward sentences, and the Everything’s a Remix™ mentor-sentence framework, is original work authored by Brittaney McKay and owned by In Between the Lattes, LLC. The expression of these frameworks in writing, including their lessons, mentor and anti-mentor sentence sets, practice routines, games, and all associated instructional materials, is protected by copyright as original creative work.

These frameworks were developed over years of classroom practice and educator training. They are the original instructional IP that powers FIX it!™ and may not be reproduced, taught for compensation, sold, or used to build derivative products or AI systems without written license from In Between the Lattes, LLC.

Curriculum & Content

All passages, question banks, distractor analyses, evidence arrays, teacher annotations, and rubrics included in FIX it!™ are proprietary works authored or commissioned by In Between the Lattes, LLC. Library content is licensed for use within an active subscription only. Content may not be:

  • Copied, redistributed, or reproduced outside of an authorized license
  • Used to train other AI models or systems
  • Republished in print or digital form without written permission
  • Modified to create derivative test materials sold or distributed by third parties

Platform & Software

The FIX it!™ platform, including its interface design, AI prompt engineering, scoring logic, dashboards, reporting features, and all underlying source code, is the proprietary work of In Between the Lattes, LLC. Reverse engineering, scraping, automated access, or re-hosting the platform is prohibited. Certain elements of the platform’s architecture may be the subject of pending or contemplated patent protection in the United States.

Teacher & Student Work

Teachers retain ownership of any original passages, questions, or instructional materials they upload to the platform. By uploading, teachers grant In Between the Lattes, LLC a non-exclusive license to host and display the materials within their account and to authorized students. Student responses and assessment data remain the property of the school under FERPA.

Reporting Misuse

If you encounter unauthorized use of FIX it!™ trademarks, the Sentence Bad Guys and Everything’s a Remix frameworks, or proprietary content, please report it to hello@thegrammarthattalksback.com. Schools and districts that have questions about permitted uses under their license should contact us before redistributing any materials.
